Terms of Service

Effective Date: October 3, 2026

1. Acceptance of Terms

By accessing or using MedGuardian (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Medical Disclaimer

MedGuardian is a medication scheduling and tracking application. It is NOT a doctor, hospital, emergency service, or diagnosis system. The Service is not a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay in seeking it because of information provided by the Service. In a medical emergency, contact your local emergency services or a qualified healthcare professional immediately.

3. Medication Liability Language

MedGuardian provides tools to help you track your schedule. However:

  • You are solely responsible for entering accurate medication names, dosages, and schedules.
  • Schedules must be configured according to instructions provided by qualified healthcare professionals.
  • MedGuardian does not prescribe medication or verify clinical safety.
  • Reminders and notifications are provided as a convenience and are not guarantees of clinical safety or adherence.
  • You should not rely on MedGuardian as your sole safeguard against missed or incorrect doses.

4. Beta Service

MedGuardian is currently operating as a free beta service. We do not promise uninterrupted availability, specific uptime SLAs, enterprise support, or guaranteed delivery of push notifications and reminders. The service may be modified, suspended, or discontinued at any time.

5. Eligibility

You must be capable of forming a binding contract to use the Service. The Service is not intended for independent use by young children without parental supervision.

6. Account Registration and Security

You must provide accurate information when registering. You are responsible for maintaining the confidentiality of your password and account session, and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

7. Permitted Use

You may use the Service only for your personal, non-commercial medication management and caregiver coordination. You agree not to misuse the Service, reverse-engineer its infrastructure, or bypass its security controls.

8. Prohibited Use

You must not:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Provide false or misleading health information that could endanger yourself or others.
  • Use the Service to provide automated clinical diagnoses.

9. Caregiver Relationships

Patients may explicitly invite caregivers to view their medication information. Caregivers must use this access responsibly and respectfully. Caregiver access does not make the caregiver a healthcare professional. Caregivers must not rely on MedGuardian as the sole source for emergency or clinical decisions regarding the patient.

10. User Content and Data

You retain ownership of the data you submit to the Service. By using the Service, you grant us a license to process and store your data strictly for the purpose of operating the application and providing the Service to you and your authorized caregivers.

11. Intellectual Property

The MedGuardian application, logo, design, and source code architecture are the intellectual property of MedGuardian and its licensors. You may not copy, modify, or distribute the application software.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and process your personal and health data.

13. Third-Party Services

The Service relies on third-party infrastructure (e.g., hosting, database, email, and push notification providers). We are not responsible for the independent operational failures of these third-party platforms.

14. Suspension and Termination

We reserve the right to suspend or terminate your account at any time, without notice, for conduct that violates these Terms or is harmful to other users or the Service infrastructure.

15. Account Deletion

You may request deletion of your account. Upon deletion, your right to use the Service immediately ceases, and your data will be removed in accordance with our Privacy Policy.

16. Disclaimers and Limitation of Liability

The Service is provided "As Is" and "As Available" without warranties of any kind.

To the maximum extent permitted by law, MedGuardian shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of health, life, profits, or data, resulting from your use of or inability to use the Service.

17. Indemnification

You agree to indemnify and hold harmless MedGuardian and its operators from any claims, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.

19. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
